These Terms of Service govern your use of the internet services and website provided by Bulanet (www.bulanet.co.za). By activating our services, you agree to be bound by these terms.

1. Service Provision

  • Activation: Services are activated upon successful installation and payment confirmation.
  • Best Effort Service: Unless a dedicated Service Level Agreement (SLA) is signed, all home and business internet services are provided on a “best effort” basis. Speeds may vary due to network congestion or infrastructure provider (FNO) issues.
  • Hardware: Any equipment provided by Bulanet (e.g., routers) remains the property of Bulanet unless fully paid for or otherwise stated in your specific package.

2. Acceptable Use Policy (AUP)

You agree not to use Bulanet’s network for:

  • Illegal Activities: Any activity that violates South African law.
  • Abuse: Sending unsolicited bulk mail (SPAM) or hosting malicious software.
  • Interference: Attempting to disrupt the service of other users or the integrity of the network.
  • Reselling: You may not resell Bulanet services to third parties without a formal wholesale agreement.

3. Billing and Payment

  • Monthly Subscription: Services are billed in advance on a monthly basis.
  • Payment Methods: Payments are typically collected via Debit Order or EFT.
  • Suspension: Failure to pay by the due date may result in automatic service suspension. A reconnection fee may apply.
  • Cancellations: We require 30 days’ written notice for the cancellation of services.

4. RICA Requirements

In accordance with the Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA), you are required to provide:

  1. A certified copy of your ID or Passport.
  2. Proof of residence (not older than 3 months). Services cannot be activated until RICA verification is complete.

5. Limitation of Liability

Bulanet shall not be liable for any loss of profits, data, or business interruptions caused by:

  • Service outages beyond our reasonable control (e.g., load shedding, cable theft, or FNO failures).
  • Unauthorized access to your home network due to weak passwords or security.

6. Privacy

Your use of our services is also governed by our Privacy Policy, which details how we handle your personal information in compliance with POPIA.

7. Modifications to Terms

Bulanet reserves the right to modify these terms at any time. We will notify you of significant changes via the email address linked to your account. Continued use of the service constitutes acceptance of the new terms.

8. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
